New & Up-And-Coming Legislation for Community Associations in North Carolina
There are several major bills introduced in the NC General Assembly concerning HOAs in 2013. Three bills will be enacted as law this year:
Senate Bill 228
This bill has three main sections. The provisions for SB 228 are:
- That HOA and condo unit owners must allow access to common areas/elements when it is needed for repair, replacement, or maintenance.
- The basis for the “legal authority for the planned community” was clearly defined as the declaration, the by-laws, and the articles of incorporation.
- The amendments made by an association to their governing documents are valid and enforceable.
House Bill 278
This bill, which became law on the 1st of July, allows for owner and HOAs in a dispute to voluntarily choose mediation as an alternative to litigation. In addition, association are required to inform residents of their right to mediate any disputes.
House Bill 331
HB 331 aims to standardize the process used by community associations to collect and enforce claims of liens and foreclosures. Associations will now appoint a trustee to conduct foreclosures filed after the 1st of October. In this sense, foreclosures by an association will be similar to mortgage foreclosures.
Other bills that were not yet enacted but were introduced include:
House Bill 871
This addresses many aspects of the local industry. It aims to have HOA and condo property managers regulated by the Real Estate Commission. If the bill is adopted, community association managers would be required to become licensed real estate brokers starting in October of this year. This bill also seeks to regulate management contracts by limiting them to a one year term and mandating an escape clause.
